In a bid to receive accurate figure and statistics, Delhi government on Tuesday following the order of court has made it mandatory to register marriages within 60 days, if couples fail to do so, they would have to pay fine, Delhi officials say.
According to sources, the Delhi Government has formulated the Marriage and Divorce Registration Bill after Supreme Court's order and Home ministry of Delhi government has cleared the draft.
The Draft bill is scheduled to be table in Delhi Assembly next week in the budget session. According to bill, all marriages, whether it was held under Hindu Marriage Act or Special Marriage Act or any other act needs to be get registered in the Marriage Registrar office.
Moreover, if one of the couple is Delhi resident, need to get registered his/her marriage whether the marriage process held any where in India or abroad.
According to provision of new Marriage Registration bill, for registering marriage in Delhi's marriage registrar office, it is mandatory that at least one partner should be the resident of Delhi and should come under its jurisdiction, or the marriage should be solemnized in an area under it.
Both the parties must be accompanied by a witness.
In case, the couple gave false information, there is a provision of a maximum punishment of three-months jail.
"Registration will prevent child marriage, check bigamy or polygamy and help women exercise their right of maintenance and custody of children and enable widows to claim inheritance," the official said.
In 2006, the SC had in a landmark judgment made registration of marriages compulsory.
