Aug 24: For some time judiciary has pronounced such welcoming judgements which have been instrumental in enhancing the faith of people in the criminal judicial system of the country. But there is one agency which has often failed to deliver its honest services on this front. The central investigating agency CBI has been chided by the court in many cases for not dealing with the case seriously especially when the accused ones are from the influential background mainly from political and administrative.
What an irony that the investigating agency becomes the pawn in the hands of corrupt politicians and under pressure goes to the extent of manipulating the facts and evidences and keeping the decisive information back from the court.
This has set as trend to bow down to the influence coming from political galleries. The trend needs to be supported by certain references of well known cases.
Just two days ago Shibu Soren has been acquitted in the murder case of his private secretary, Shashi Nath Jha. Court quoted that premier investigating agency has ‘miserably failed’ to prove the charges against the former union cabinet minister. This is not surprising. CBI never succeeds in finding evidences against the people from political yards. Soren is also facing charges of massacre in 1975. Does not matter.
In Taj corridor scam even after the instructions from the Supreme Court CBI delayed in filing FIRs against UP CM Mayawati. Political factors came in way of law.
Matto murder case has been glaring example in which few CBI officials turned every stone to tilt the case in the favour of accused Santosh Kumar Singh. It neither bothered to catch the domestic help of Priyadarshini while the simple job was done by a journalist. There were various lapses in the case.
CBI also attempted to tease the evidences against the accused. CBI was chided by the court for holding necessary evidences back from the court. They not only manipulated DNA evidence but also did not provide the finger print report and the broken helmet Santosh was wearing at the time of committing the crime to the court. CBI did not present two important evidences and witnesses before court which could have gone against the accused. It took almost 11 years to get justice. Thanks to the CBI.
Not to forget that Quattrochi case is also there in which CBI lowered country’s prestige when it could not extradite him from Argentina and was slapped to bear the legal expenses of the accused.
Even Hinduja brothers were acquitted in the case just due to the fact that the CBI did not have certified photocopies of the documents from the Swedish authorities presented to the court.
CBI has also started probe in disproportionate asset of Mulayam Singh Yadav. Can we be hopeful for an honest probe and trial? As the governments change CBI has to change its moves.
Why does the agency fail to resist the ‘influences’? Any government official is recruited to serve the nation and not the government or individuals and supposed to work in the interest of nation. Where goes that commitment at such crucial periods? Whom are they accountable? To political patrons or to the public for which the whole system has been built?
List is long. And these are just highlighted ones. What about which never catch eye of the public or conscious citizens.
