CVC appointments: PJ Thomas withdraws plea

New Delhi, July 19 (ANI): Former Central Vigilance Commissioner (CVC) PJ Thomas on Tuesday withdrew his plea from the Delhi High Court in which he had sought a stay on the appointment of his successor till the President decides on the appeal against his dismissal

 

The Delhi High Court had on July 13 declined to give urgent hearing to the plea of Thomas.

 

The Division Bench of Justice Vikramjit Sen and Justice Siddharth Mridul held that hearing the petition and passing any directive on the day when the new CVC was scheduled to be sworn in could only complicate the matter further.

 

The appointment of Thomas was quashed by the Supreme Court citing a pending chargesheet in a corruption case against him in Kerala. Thomas was appointed as CVC in September 2010.

 

The counsel for Thomas cited Article 145 (3) of the Constitution saying that those issues connected with the interpretation of the Constitution have to be decided by a minimum five-judge bench.

 

The Centre for Public Interest Litigation, an NGO, and others had earlier challenged appointment of Thomas as the CVC, quoting the Palmolein import corruption case in which Thomas is an accused. (ANI)
