Showing a concern regarding unregulated clinical trials being conducted in the country, the Supreme Court Monday asked the central government to furnish details of clinical trials across the country, including the side effects and deaths, if any.
The apex court bench of Justice R.M. Lodha and Justice Anil R. Dave, asked the central government to furnish the details. The bench also issued notice to all state governments to know whether they were being kept in the loop regarding clinical trials in their states.
The apex court also sought information whether the states have any special laws or regulations to regulate clinical trials.
The Supreme Court also expressed its anguish pertaining to these trials related to human beings, and said, "We are concerned about the lives of human beings who become subjects of clinical trials unknowingly and helplessly, pointing to the process of malpractices by doctors and drug companies."
The court refused to accept the Madhya Pradesh government's plea that the state government was in the dark regarding clinical trials being performed in the state.
The court said clinical trials were performed in government run hospitals by their doctors and it is hard to believe that the state government was not aware of the situation.
The apex court sought this information while hearing a PIL of non-governmental organisation Swasthya Adhikar Manch, which pointed to clinical trials being conducted in Madhya Pradesh without informing patients that such trials are being conducted on them.
