New Delhi, Mar.30 (ANI): The Supreme Court on Friday refused to take up a plea for clemency for Balwant Singh Rajoana, who has been awarded the death penalty for his role in the assassination of former Punjab chief minister Beant Singh on August 31, 1995.
A two-judge apex court bench comprising of Mr. Justices T.S. Thakur and Gyan Sudha Misra said it could not pass any direction as Rajoana has not filed any petition before it.
The two judges also said that petitioner Abhinav Ramakrishna, an advocate, has no locus standi to plead on Rajoana's behalf.
The apex court also allowed an NGO, Lawyers for Human Rights International, to withdraw its petition filed with a similar plea.
Ramakrishna's petition was filed under Article 32. It said the petition could not be entertained, as in no way was any fundamental right of the petitioner violated.
The bench said only a person whose fundamental right is violated could invoke Article 32. (ANI)
