'Clarify on withdrawal of case against Sheila Dikshit'

New Delhi, March 29 (IANS) A Delhi court Thursday asked the locus standi -- the right to address the court on a matter before it -- of Delhi Police for moving an application seeking withdrawal of a case against Delhi Chief Minister Sheila Dikshit over an alleged election code violation in 2008.

 

Metropolitan Magistrate Vijeta Singh, listing the matter for further consideration April 9, asked the public prosecutor to clear its stand for moving the application of withdrawal of the case without being a complainant in the case.

 

The court was hearing a complaint by Samajwadi Party candidate Om Prakash alleging that Dikshit violated the election code of conduct by using loudspeakers without permission during the poll campaign in November 2008.

 

The court also asked for the locus standi of the intervening application filed by Bharatiya Janata Party (BJP) leader Vijay Jolly.

 

Jolly, who contested against Dikshit in the Gole Market constituency in the 2008 assembly elections, opposed the withdrawal of the case against her by police.

 

On Feb 6, police moved an application for withdrawing the case, saying that no loudspeakers or accessories were seized during investigations.
