Pak SC refuses to take action against Musharraf

Islamabad, Mar. 28 (ANI): The Supreme Court of Pakistan has refused to take direct action against former president Pervez Musharraf over Dr Mubashir Hassan's plea seeking his disqualification from the upcoming elections. The petitioner has argued that Musharraf violated the constitution on November 3, 2007, by imposing emergency in the country, reports the Daily Times.

A three-member bench of the apex court, headed by Chief Justice of Pakistan, Iftikhar Muhammad Chaudhry, however, refused to hear the case and urged him to approach a "proper forum" for the case.

During the hearing, AK Dogar, counsel for Dr Hassan, cited the July 31, 2009, judgment of the court and said that the constitution can't be held in abeyance at the will and whim of the army chief.

Dogar said that articles 62 and 63 needed to be enforced. He said there is a declaration in the judgment against Musharraf therefore he stands convicted.

CJP Chaudhry, however, said it is the duty of the Returning Officer to look into the matter. (ANI)
