Australian jailed over punch that killed man

United Kingdom,Crime/Disaster/Accident, Tue, 27 Nov 2012 IANS

Melbourne, Nov 27 (IANS) An Australian man has been sentenced to more than two years in jail for a punch that killed his sister's partner.

Derek Graham Loo, 37, pleaded guilty to unlawful assault that caused the death of 39?year?old Mark Anthony Fryer in October 2008, the Australian Associated Press (AAP) reported Tuesday.

The case against Loo was initially dropped in 2010 because the medical evidence did not support a prospect of conviction.

However, in a coronial inquest in 2011, a medical expert changed his mind after he reviewed further evidence and concluded that Fryer's brain injury was caused by trauma and was not spontaneous.

The finding led the prosecution to re?charge Loo. He was sentenced by the Perth district court where he appeared via video from Albany courthouse.

The court heard that Loo punched Fryer in an alcohol?fuelled verbal row following a funeral they attended together.

Loo's sentence was lessened because he was sorry for what happened and was not usually a violent person, the judge said.
