Lahore High Court postpones hearing of petition against Musharraf

Lahore, Nov 2(ANI): The Lahore High Court (LHC) has postponed the hearing of a petition challenging Pervez Musharraf's election as Pakistan President in 2007.

 

A division bench, comprising Justices Chaudhry Muhammad Tariq and Syed Akhlaq Ahmad, after hearing the petitioner, Muhammad Azhar Siddique, sent the case to the Chief Justice with a request to constitute a larger bench to further look into the matter.

 

Siddiqui argued that Musharraf was inherently ineligible to contest the presidential elections, as he was then a sitting Army Chief who was under oath not to accept any other constitutional office, the Daily Times reports.

 

He said that under article 63(1) of the Constitution, a person who has not completed two years after leaving government service is not competent to contest the election.

 

He also claimed that the Election Commission of Pakistan had suspended the article to facilitate Musharraf's election. (ANI)
