The Supreme Court on Monday will hear BJP candidate from Pilibhit-Varun Gandhi’s plea in connection with the National Security Act (NSA) imposed upon him by the Mayawati government.
Varun has challenged his detention under NSA is illegal and was slapped on him out of political vendetta to stop him from contesting elections.
A bench headed by Chief Justice K G Balakrishnan will decide whether the BJP’s Pilibhit candidate will contest the Lok Sabha poll from behind the Etah jail, where he is presently locked in or from outside it. His counsel would seek Varun’s release so as to he could file his nomination paper as well as fray in polls.
The Uttar Pradesh government defending its decision of slapping NSA on Varun Gandhi had told the court that his release from the jail would pose a great threat to peace and tranquillity in the state leading to serious law and order problem in the state. The UP government has already dubbed Varun Gandhi as “national threat to communal peace and harmony”.
Varun had surrendered before the Pilibhit court after the case against him was registered under Section 153 (A) of IPC for spilling hate speeches and was later slapped by NSA.
NSA is imposed only when a person becomes a threat to national security or social peace and tranquillity, and in that case s/he cannot ask for bail for one year.
Congress has distanced itself from the controversy of imposing NSA stating it has no role in imposition of NSA on Varun Gandhi. Many other parties have also criticized UP Chief Minister Mayawati for slapping NSA on Varun.
