Amid the much speculations, the Supreme Court issued a non-bailable warrant against Sahara group chief Subrata Roy for failing to appear before it in person as directed at the court's last hearing. Roy was also given till March 4 to comply with the court's order.
In a major decision, an apex court bench of Justice K.S. Radhakrishnan and Justice J.S. Khehar, while noting that a plea was made seeking exemption from personal appearance, said this was reiterated Wednesday but would not be accepted. The case relates to the non-refund of money to investors.
The court then issued the non-bailable warrant against Roy and directed him to be present in the court March 4.
As soon as the court commenced, it enquired whether Subrata Roy and three other directors of two Sahara companies were present in court. The court was told that the directors of SIRECL and SHICL were present, but Roy could not come as he had to rush to Lucknow to see his ailing mother.
Apparently displeased, Justice K.S. Radhakrishnan said, "The arm of this court is very long. We will issue warrants. This is the Supreme Court of the land. When other directors are here, why cannot he be here?
It is noted that the Supreme Court Feb 20 had asked Roy and three directors of Sahara India Real Estate Corporation Limited (SIRECL) and Sahara Housing Investment Corporation Limited (SHICL) Ashok Roy Choudhary, Ravi Shankar Dubey and Vandana Barghava - to be present in the court Feb 26.

February 27, 2014 at 5:22 PMSubrata Roy has always complied with the apex court's order, it is just this time he wasn't able to obey and that too because of some genuine reason, he has already submitted the acknowledgements in his justification with the reason than why SC had to be so harsh?

The headline tempts many of them to open and read the article, let's see if Mr. Roy gets justice in his next appearance in the court because I feel court shouldn't have issued an order directly, SC could have given a notice and could have called him for the next date of hearing.

February 27, 2014 at 5:20 PMThe court had on February 20 come down heavily on the Sahara group, well all come down heavily when a big name is associated. This all is happening because of that Italian lady, its no surprise to me why SC isn't coming down on those people.
Even I know "Rule of Law", personal appearance is subjected to availability and other circumstances. No one can just like that issue order as such, as in it won't be a legal procedure to ply for.
