New Delhi, Nov 1 (IANS) A Delhi court has let off due to lack of evidence against him a councillor facing charges of power theft.

Additional Sessions Judge Suresh Kumar Gupta, in an order made available Thursday, acquitted Anil Sabarwal, a Bharatiya Janata Party councillor from west Delhi's Milap Nagar, saying that the private power distribution company BSES Rajdhani failed to prove his offence.

"I have no hesitation to hold that the complainant company has failed to bring home the guilt against Anil Sabarwal beyond shadow of reasonable doubt and accordingly the accused is acquitted of the offence charged," the court said.

According to the prosecution, a joint inspection team Dec 2, 2008 raided a premises in Uttam Nagar and alleged that the property belonged to the councillor who was illegally drawing electricity from the main power line.

The power company issued a bill imposing a penalty. It said during the raid labourers present on the spot said the premises was being used by Sabarwal.
