Court notice to Delhi government on encroachment

New Delhi, Oct 31 (IANS) The Delhi High Court Wednesday issued notice to the city government on a petition seeking removal of encroachment and illegal construction from pavements and roads.

A division bench of Chief Justice D. Murugesan and Justice Rajiv Sahai Endlaw also sought a response from the Delhi Development Authority, the civic agencies and police and posted the matter for Feb 6, 2013.

The public interest litigation sought "removal of encroachment, illegal constructions on pavements, covered roadside drains, parking places, common areas, green lands and to clear roads, lanes, parks, parking areas and common places for free traffic flow".

Advocate Asit Kumar Roy, appearing for petitioner Anil Dutt Sharma, said the petitioner filed various right to information applications for seeking information on encroachment and unauthorized constructions.

"Such activities are causing road accidents, road rage, traffic jams, mental agony and harassment and several other problems," the plea said.

Seeking appropriate legal or departmental action against offending officials, staff and councillors, the petition said there was rampant corruption and sharing of illegal gratification have been going on between police, local councillors and higher officials on the money collected from illegal encroachment and construction.
