Chief Justice of India asks HC judges to strengthen jurisprudence

Mumbai, Aug 18 (ANI): Chief Justice of India, S.H. Kapadia, on Saturday called upon the high court judges to be committed to strengthen the integrity of the judiciary.

CJI Kapadia, who was speaking at the concluding function of the sesquicentennial celebrations of the Bombay High Court, said that this historic court has produced several legal luminaries over the past 150 years, including distinguished Chief Justices and other judges.

"The Bombay High Court has produced Chief Justices and judges of great distinction, erudition and worth. The distance of time does not separate them from us, which entitles us to remember them and their judgements and their writings with due measure of praise. This is a happy occasion for all those connected with this great institution," he said.

CJI Kapadia asserted that the high court judges should aim to protect the integrity of the judiciary, as it was a vital matter of public expectation and the entire society against numerous odds.

"In the past, the integrity of the judiciary was taken for granted. Today, judicial integrity is a matter of strong public expectation. This is a vital difference which, we must keep in mind and I expect the High Court judges of the future and the entire judiciary to endeavour to fulfill this expectation of the people of judicial integrity," he added.

CJI Kapadia also highlighted that the courts are required to appreciate their proper role within the ambit of the Constitution.

He further observed that the powers and process of the government are in conflict with the morality of law, an issue that needs to be tackled logically.

"The powers and the process of the government are many a times constrained by factors such as ballot box, party machinery, parliamentary arithmetic, external circumstances and even public opinion. These often conflict with the morality of law," said CJI Kapadia.

"The judges are duty bound to protect the rights of individuals under Part III of the Constitution. The government is equally bound by the morality of the government based on utilitarianism," he added.

Prime Minister Dr. Manmohan Singh, Union Law and Justice Minister Salman Khurshid, Maharashtra Governor K. Sankaranarayanan, Maharashtra Chief Minister Prithviraj Chavan, Attorney General G.E. Vahanavati, Goa Governor B.V. Wanchoo, and Goa Chief Minister Manohar Parikkar were also present on the occasion. (ANI)
