Supreme Court to hear police appeal in BMW hit-and-run case

New Delhi, Apr 12 (ANI): The Supreme Court will hear an appeal filed by the city police challenging the lenient punishment imposed by the Delhi High Court to Sanjeev Nanda, found guilty in the BMW hit-and-run case.

 

The city police contended that Nanda, grandson of former Navy Chief S M Nanda, should be convicted under the stringent provision of Section 304 (2) of the Indian Penal Code (IPC), dealing with culpable homicide not amounting to murder.

 

The law prescribes 10 years imprisonment as maximum punishment.

 

The trial court had last year in July convicted and sentenced Sanjeev Nanda to five years imprisonment.

 

Nanda, whose sentence was later reduced to two years by the Delhi High Court, is out of jail now after serving his term.

 

Besides Nanda, the court had also convicted Rajiv Gupta and Bhola Nath and sentenced them to one year and six months in jail, respectively for destruction of evidence.

 

The ten-year-old case involving Nanda, allegedly in an inebriated state is accused of mowing down seven people with his high speeding BMW car in the wee hours of January 10, 1999, in Lodhi Colony area.

 

Nanda had mowed down seven people, including three policemen, while drunk and driving his BMW car. Six persons died on the spot, while one survived. (ANI)
