Sukhna scam: High Court dismisses Lt Gen Rath's petition

New Delhi, Feb 15 (ANI): The Delhi High Court on Monday offered no relief to Lieutenant General P K Rath, who had challenged the initiation of court of inquiry against him in the Sukhna land scam on grants of jurisdiction.

 

A two-judge division bench headed by Justice Geeta Mittal dismissed Rath's petition and asked him to approach the Armed Forces Tribunal to challenge the proceedings against him.

 

"Jurisdiction of this court is barred by Armed Forces Tribunal Act. In view of this, the petition is dismissed with liberty to petitioner to approach the tribunal," said Justice Mittal.

 

Rath had approached the court after he was charged in the over Rs 300 crore land scam in Darjeeling along with former Military Secretary Lieutenant General Avadesh Prakash.

 

Rath and three other Generals have been indicted by an Eastern Army Command Court of Inquiry for giving a No-Objection Certificate (NOC) to a private realtor to construct an educational institute on a plot of land adjacent to the Sukhna Army base in Darjeeling.

 

Besides Prakash and Rath, the army probe had indicted Lieutenant General Ramesh Halgali and Major General P C Sen in the scam. (ANI)
