Aug 13: Squashing the Sessions Court’s order of granting bail to one of the accused in the Gujarat fake encounter case the apex court today cancelled the bail granted to Superintendent of Police Narender Amin. Amin was earlier arrested under section 201 IPC and not murder that forced the Ahmedabad court of granting anticipatory bail to him.
However, Gujarat government on Friday filed a petition in the Supreme Court seeking the cancellation of bail, as the public persecutor termed the detention of Amin is important as his involvement seems certain in Sohrabuddin and his wife Kausar Bi’s murder with other 12 accused.
SC bench headed by Justice Tarun Chatterjee and P K Balasubramanyan overturned the anticipatory bail on a special leave petition filed by the Gujarat Government.
DSP Narender Kumar Amin was arrested on the basis of a police driver’s statement who had confirmed the presence of Amin at the site of Kausar Bi’s murder and later cremation. However, the driver had later refused of naming Amin, which believed to be result of threat to the witness’s life. On the basis of this, Amin’s advocate had got bail citing that there is no direct evidence against Amin.
Apart from Amin the investigating team had also taken 12 other officers including 7 senior IPS officers of Gujarat into custody and all are under interrogation. The state CID special investigating team had also complained that while out on bail Amin did not cooperate with the police and hence they wanted for custodial interrogation.
