Islamabad, Dec 29(ANI): Former Pakistan envoy Husain Haqqqani's counsel, Asma Jehangir has pleaded before the Supreme Court that American-Pakistani businessman Mansoor Ijaz be summoned before the bench for cross-questioning in connection with the Memo Gate probe.
"If the trial is to take place at the apex court, then Mansoor Aijaz should be called. We are geared up to cross-question him," The Daily Times quoted Jehangir, as saying.
"The petitioner is supposed to tell the court whose fundamental rights have been affected," he added.
She said the due process of law has not been followed because the probe was filed in the apex court rather than before the judicial magistrate.
Justice Chaudhary said the Memo Gate probe would be more transparent under the judiciary, adding that the court was empowered to intervene in any issue involving public interest and a breach of fundamental rights.
Jehangir also pointed out that the petitions filed with regard to the memo were vague and based on hypotheses.ustice Chaudhary countered her argument saying Pakistan army chief General Ashfaq Parvez Kayani and Inter-Services Intelligence (ISI) Director General Lieutenant General Ahmed Shuja Pasha had acknowledged the existence of the memorandum.
He also observed that Pakistan Prime Minister Yousuf Raza Gilani had not denied its presence, adding that though President Asif Ali Zardari had not submitted his rejoinder, it did not mean that he had denied the existence of the memo.
Asma said that Haqqani was liable to face a criminal case if his involvement in the scandal was proved, and likewise Zardari was liable to face an impeachment case, if found guilty in the scandal.he said unlike a parliamentary probe, judicial probe was incapable of probing the issue from all angles.
