Tom Cruise might claim Suri Cruise custody

After 5 years of marriage, Katie Holmes has filed for a divorce with Tom Cruise in New York citing "irreconcilable differences".

Katie while filing for divorce asked for sole legal custody of their six-year-old daughter Suri Cruise.

Now if rumors are to be believed, Tom Cruise will also be setting up for a high profile legal battle to contest her claim for Suri.

Though Tom and Katie signed a prenuptial agreement before their wedding in November 2006, Tom might give a share of his 160-million-pound fortune.

This prenup guarantees Holmes a yearly sum.

Tom and Cruise were last clicked together in February.

She remained absent from the red carpet of Tom's recently released Rock of Ages.

"He could choose to give Katie a bigger settlement, as Tiger Woods did with his wife, but that will be his choice", said a legal expert.

Cruise has went through 2 divorces before:

• First one was with Mimi Rogers with whom he was married from 1987 to 1990
• Second one was with Nicole Kidman with whom he was married from 1990 to 2001. With Nicole Tom adopted two children.

Cruise (49) proposed Holmes (33) at the Eiffel Tower in Paris and married her in an Italian castle.

He is currently shooting for Oblivion, a sci-fi movie.

Prenuptial agreement: Prenup is an agreement between people, which commonly includes terms for division of property and spouse support in case of divorce. This agreement sometimes also includes provision for forfeiture of assets and conditions of guardianship.
