US judge dismisses Armstrong's case against USADA

Johannesburg, Tue, 21 Aug 2012 ANI

Johannesburg, Aug 21 (ANI): A US judge has dismissed champion cyclist Lance Armstrong's case against the US Anti-Doping Agency (USADA), paving way for the agency's drug case against the seven-time Tour de France winner to proceed.

Earlier, Armstrong had filed a case against the USADA, arguing that it lacked jurisdiction to pursue a case against him and claimed that the agency's arbitration process are in violation of his US constitutional right to a fair trial.

"We are pleased that the federal court in Austin, Texas, has dismissed Lance Armstrong's lawsuit and upheld the established rules which provide Congressionally-mandated due process for all athletes," Sport24 quoted USADA chief executive Travis Tygart, as saying in a statement.

The judge claimed that the matter would be "best resolved through the well-established system of international arbitration, by those with expertise in the field, rather than by the unilateral edict of a single nation's courts."

Apparantly, Armstrong wanted the judge to issue an injunction banning the USADA from pushing its case to an arbitration hearing, the next step in procedures, which could lead the case to be settled by the Court of Arbitration for Sport.

If the doping charged are found to be true, Armstrong could be stripped of his titles and face a lifetime ban from cycling. (ANI)
